TVR hire - Terms and Conditions

1. Agreement

When you sign the Rental Agreement, you accept the conditions set out below.

Please read this agreement carefully. If there is anything you do not understand or do not agree with, please ask us.

2. Definitions

You / Hirer: The driver and any additional drivers named in the rental agreement who are authorised to drive the vehicle(s)

3. Bookings

Bookings can be made by Visa or Mastercard credit or debit cards. Bookings will be confirmed when payment has cleared. Cash will not be accepted.

4. Rental Period

The Hirer will have the vehicle for the rental period shown in the rental agreement. We may agree to extend this rental period but the rental period shall never be more than 30 days.

If you do not bring the vehicle back on time you are breaking the conditions of this agreement and you will not be insured. If you are unavoidably delayed you must inform us before the hire period runs out. We can charge you for every day or part day you have the vehicle after you should have returned it to us. Until we get the vehicle back we will charge you the daily published rate.

Our hours of hire are between 09.00 on the first day of hire to 19.00 on the last day of hire.

5. Your Responsibilities

You must :

  1. Pay the charges for the rental period and any other costs you incur under this agreement
  2. Look after the vehicle, the keys to the vehicle and the contents of the vehicle
  3. Lock the vehicle when you are not using it and use any security devices fitted to it or supplied with the vehicle
  4. Protect the vehicle against bad weather which can cause damage
  5. Ensure you use the correct fuel
  6. Return the vehicle with a full tank of petrol. (All vehicles are supplied with a full tank of petrol). Failure to do so will result in a charge for the fuel plus an administration charge of £10
  7. Let us know as soon as you become aware of a fault in the vehicle
  8. Bring the vehicle back to the place we agreed during published opening hours and ensure one of our staff checks that the vehicle is in good condition and the contents are accounted for. If we have agreed that you may return the vehicle outside of business hours, you will remain responsible for the vehicle and its condition until it is re-inspected by one of our staff
  9. Pay for the reasonable costs of repair or cleaning required to bring the vehicle back to it's condition when the pre-rental inspection was carried out
  10. Ensure you remove any personal belongings from the vehicle prior to offering it to one of our staff for inspection
  11. Abide by any specific instructions relating to the vehicle as explained during the familiarization process

You must not :

  1. Use the vehicle for any illegal purposes
  2. Use the vehicle for hire or reward
  3. Sell or dispose of the vehicle or any of it's parts or contents
  4. Give anyone legal rights over the vehicle
  5. Use the vehicle for any form of motor sports including racing, rallying, track days, testing the vehicle's reliability or speed, pace-making or teaching someone else to drive or anything else we may consider to be misuse or abuse
  6. Use the vehicle whilst under the influence of alcohol or drugs
  7. Use the vehicle for towing
  8. Use the vehicle outside of the England, Scotland and Wales, unless we give you written permission
  9. Load the vehicle beyond the manufacturer's maximum weight recommendations
  10. Let anyone work on the vehicle without our permission
  11. Smoke in the vehicle (it is illegal, even with the hood down)
  12. Allow pets into the vehicle

6. Our Responsibilities

We will ensure that:

  1. the vehicle is maintained to at least the manufacturer's recommended standard and is roadworthy
  2. the vehicle matches our description of it at the start of the rental period

7. Charges

You will pay the following charges we work out using our current price list:

  1. The rental and any other charges we work out according to this agreement
  2. Any charges for delivery or collection of the vehicle at our published rates
  3. The cost of repairing any damage to the vehicle and/or losses of keys or contents and/or excessive cleaning. External labour and parts will be charged at cost and our own labour charged at £20 per hour
  4. A refueling service charge if you return the vehicle with less fuel than supplied by us originally
  5. All fines and court costs for traffic, parking or other offences which we have to settle on your behalf, in default of you not doing so, including our reasonable administration costs. You are responsible for paying the appropriate authority on demand
  6. Interest at a rate 4% above the base lending rate of Natwest Bank calculated on a daily basis for any amount you do not pay us on time
  7. In exceptional circumstances, a loss of income charge is required if due to customer negligence, exceptional abuse or carelessness we cannot rent out the vehicle because it is stolen, damaged and in need of repair or written off and we are awaiting recompense of the vehicles full value from our insurers
  8. If you do not pay any of these charges you will be responsible to pay our reasonable administration costs and any debt collection charges which arise
  9. You are responsible for all charges even if you have asked someone else to be responsible for them

8. Insurance

We will provide fully comprehensive insurance and 24 hour breakdown/relay cover strictly in accordance with the following criteria which are a condition of hire:

The Hirer of the vehicle must have held a full UK/EU valid driving licence for at least 5 years and

  1. have a full UK/EU driving license for a minimum of five years
  2. Be aged between 25 to 70 years inclusive for the duration of the rental period
  3. Not be convicted of a motoring offence within the last five years or had their licence suspended within the last ten years or have a prosecution pending, or have more than 6 points on their licence
  4. Not have been refused any motor insurance or had a policy cancelled or renewal refused or been required to pay an increased premium or had special conditions imposed by an insurer
  5. Not declared to the DVLA any heart disorder, diabetes, fits or physical infirmity or that they are regularly taking prescribed medication
  6. Not be engaged or connected with any of the following; Entertainment or the Theatre, Professional Sports, Racing, Gambling or on-course Bookmakers

Any person not meeting these criteria will not be insured.

The Hirer will be required to make a declaration confirming their eligibility on the Rental Agreement. By signing the agreement, you are accepting the terms of our fully comprehensive insurance policy.

A copy of the Hirer's paper driving licence will be taken before the vehicle is let out on hire and a secondary proof of address for the main driver (i.e. utility bill) will be required.

The Hirer must cover an excess charge on any claim. A refundable deposit will be taken prior to hire commencing to cover this excess by way of a pre-authorisation on a credit card only.

We reserve the right to refuse to hire any of the vehicles at our own discretion.

9. Liability

Our liability is limited to a refund of the hire charge paid to us. No consequential loss liability will be covered. Customers may park their vehicles at our property at their own risk.

10. Choice of Car or Adverse Weather

In the event of your chosen vehicle being unavailable for any reason or adverse weather conditions (snow, ice or serious flooding), we will inform you as soon as we are able and offer either an alternative vehicle or an alternative date.

11. Accident Procedures

If you have an accident you must not admit liability. You should:

  1. Take the names and addresses of everyone involved, including witnesses
  2. Take photos and make notes
  3. Call the Police straight away if anyone is injured or there is a dispute over who is responsible
  4. Call the Owner

You must then fill in and submit to us our accident report form and assist with any claims procedure.

12. Ending the Agreement

If you are a consumer, we will end this agreement if:

  1. Your belongings have been taken away to pay any debts
  2. A receiving order has been made against you
  3. You do not meet the main conditions of this agreement
  4. You do not meet the requirements of our insurer

If you are a company, we will end this agreement if:

  1. You go into liquidation
  2. You call a meeting of creditors
  3. we find out that your goods have been taken away to pay any debts
  4. You do not meet any of the conditions of this agreement

If we do end this agreement it will not affect our right to receive any money we are owed under this agreement. We can repossess the vehicle (and charge you our reasonable costs for doing so) without using unreasonable force or causing damage.

13. Cancellation Policy

In the event of you cancelling the following will apply:

  1. More than 30 days before the start of the rental period we will refund the full payment
  2. Between 15 days and 29 days before the start of the rental period we will refund the full payment less an administration fee of £50
  3. Less than 14 days before the start of the rental period you will forfeit the full payment

In the event that we have to cancel we will give you as much notice as we are able and provide a full refund of your payment or offer an alternative vehicle.

14. Information

You agree that we may use any information that you have given us to carry out our market research. We will not pass your information onto other parties except if you break this agreement and we may pass details onto the DVLA, credit reference agencies, debt collectors and any other relevant organisation.

15. Governing Law

This agreement is governed by the laws of England.
